BlueEM Terms of Use
Welcome to BlueEM. These Terms of Use govern your access to and use of the BlueEM website, platform, newsletters, alerts, dashboards, summaries, AI-assisted notes, data, and related services.
By accessing or using BlueEM, you agree to these Terms. If you do not agree, you should not use BlueEM.
1. About BlueEM
BlueEM is a news discovery, monitoring, prioritization, and intelligence platform. BlueEM helps users identify, organize, filter, prioritize, and contextualize news and information from third-party publications and other sources.
BlueEM is not a publisher of the underlying third-party articles referenced through the platform. Unless expressly stated otherwise, BlueEM is not affiliated with, sponsored by, approved by, or endorsed by any third-party publisher, news organization, data provider, company, or rights holder referenced on the platform.
2. Third-Party Content and Publisher Rights
BlueEM may display or provide access to source names, article titles, links, publication dates, metadata, tags, categories, short factual descriptors, AI-assisted notes, summaries, translations, alerts, and other discovery or workflow tools relating to third-party news items.
All third-party articles, headlines, trademarks, logos, images, videos, data, and other materials remain the property of their respective owners, publishers, authors, licensors, or rights holders. BlueEM does not claim ownership of third-party content.
BlueEM is designed to help users discover and prioritize information. It is not intended to replace access to, subscriptions to, or reading of the original publications. Users should consult the original publisher for the full article, original wording, complete context, corrections, updates, images, graphics, and related materials.
Users are responsible for complying with the terms, conditions, licenses, and access restrictions of any third-party publisher or website they visit through links provided by BlueEM.
3. Source Links
BlueEM may provide links to third-party websites, publications, platforms, or services. These links are provided for convenience and informational purposes only.
BlueEM does not control third-party websites and is not responsible for their content, availability, accuracy, policies, business practices, or terms of use. Accessing third-party websites is at your own risk.
4. AI-Assisted Content
BlueEM may use artificial intelligence, machine learning, natural language processing, automation, and other technologies to classify, tag, prioritize, summarize, translate, or generate notes about news items and other information.
AI-assisted content may contain errors, omissions, inaccuracies, outdated information, hallucinations, misclassifications, or incomplete context. BlueEM does not guarantee that AI-assisted outputs are accurate, complete, current, reliable, or suitable for any particular purpose.
Users should independently verify all information against the original source before relying on it. AI-assisted notes, summaries, translations, rankings, and recommendations are provided for informational and workflow purposes only.
5. No Investment, Legal, Tax, or Professional Advice
BlueEM is provided for general informational purposes only.
Nothing on BlueEM constitutes investment advice, financial advice, legal advice, tax advice, accounting advice, securities research, credit analysis, due diligence, valuation advice, or a recommendation to buy, sell, hold, finance, invest in, lend to, or otherwise transact in any security, company, fund, asset, instrument, or investment strategy.
Users are solely responsible for their own business, investment, legal, tax, and financial decisions. Before making any decision, users should consult their own professional advisors.
6. User Accounts
Certain features of BlueEM may require a user account. You agree to provide accurate, complete, and current information when creating or maintaining an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must promptly notify BlueEM of any unauthorized access or suspected security breach.
BlueEM may suspend, restrict, or terminate your account if we believe you have violated these Terms, misused the platform, created legal risk for BlueEM or third parties, or used the service in a way that may harm BlueEM, other users, publishers, or rights holders.
7. Permitted Use
Subject to these Terms, BlueEM grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the platform for your internal business or personal informational purposes.
Unless otherwise agreed in writing, you may not use BlueEM content or outputs for republication, resale, redistribution, public display, mass distribution, or incorporation into another commercial product or service.
8. User Restrictions
You may not, directly or indirectly:
- copy, reproduce, republish, redistribute, resell, sublicense, or commercially exploit BlueEM content except as expressly permitted by BlueEM in writing;
- scrape, crawl, harvest, download, index, mirror, frame, cache, archive, or bulk export content from BlueEM;
- use automated systems, bots, spiders, scripts, or similar tools to access BlueEM, except as expressly authorized by BlueEM;
- reverse engineer, decompile, disassemble, or attempt to derive source code, models, algorithms, workflows, prompts, ranking logic, or system architecture from BlueEM;
- use BlueEM to build, train, fine-tune, improve, benchmark, or validate any competing product, dataset, database, search engine, news aggregation service, AI model, machine learning system, or content-monitoring tool;
- remove, obscure, or alter attribution, source links, copyright notices, trademarks, disclaimers, or proprietary notices;
- use BlueEM to circumvent paywalls, access restrictions, publisher terms, copyright protections, technical barriers, or subscription requirements;
- use BlueEM in a manner that infringes, misappropriates, or violates the rights of BlueEM, publishers, authors, data providers, or other third parties;
- use BlueEM to transmit unlawful, defamatory, misleading, harmful, abusive, or malicious content;
- interfere with the security, integrity, availability, or operation of the platform.
9. Intellectual Property of BlueEM
BlueEM and its platform, software, design, layout, user interface, databases, taxonomies, tags, classifications, workflows, rankings, watchlists, alerts, analytics, AI-generated organization layers, proprietary notes, original commentary, and other BlueEM-created materials are owned by BlueEM or its licensors.
Except for the limited right to use the service under these Terms, no rights are granted to you in or to BlueEM’s intellectual property.
The name “BlueEM,” the BlueEM logo, and related names, marks, designs, and branding are trademarks or proprietary identifiers of BlueEM. You may not use them without BlueEM’s prior written consent.
10. User Content and Feedback
If you submit, upload, save, or transmit information to BlueEM, including preferences, watchlists, notes, comments, search queries, alerts, files, or feedback, you represent that you have the right to do so.
You grant BlueEM a limited right to use such information as necessary to provide, maintain, secure, personalize, improve, and support the service.
If you provide suggestions, ideas, feedback, or recommendations regarding BlueEM, you agree that BlueEM may use them without restriction or compensation to you.
11. Copyright and Publisher Complaints
BlueEM respects the rights of publishers, authors, journalists, data providers, and other rights holders.
If you believe that material available through BlueEM infringes your rights or is displayed in a manner inconsistent with your rights, please contact us at:

- the relevant BlueEM URL or location;
- the original source URL, if applicable;
- your name, company, and contact information;
- a description of the rights you claim;
- the action you request;
- a statement that the information you provide is accurate.
BlueEM may remove, disable, modify, restrict, or review access to disputed material in its discretion while the issue is evaluated.
12. Privacy and Data Protection
BlueEM collects and processes personal data in accordance with its Privacy Policy.
By using BlueEM, you acknowledge that BlueEM may process information such as your name, email address, company, login data, subscription information, preferences, watchlists, saved searches, usage data, device data, communications, and other information necessary to provide and improve the service.
Please review our Privacy Policy for more information about how we collect, use, store, share, protect, and delete personal data, and how users may exercise their rights under applicable data protection laws, including Brazil’s Lei Geral de Proteção de Dados, where applicable.
13. Subscription and Payment Terms
Certain BlueEM features may be available only through paid subscriptions.
Subscription fees, billing cycles, payment terms, renewal terms, cancellation rules, taxes, and refund policies will be disclosed at the time of purchase or in the applicable order form.
Unless otherwise stated, subscription fees are non-refundable. BlueEM may change pricing or subscription plans upon prior notice, subject to applicable law and any written agreement with the user.
14. Availability and Changes to the Service
BlueEM may modify, suspend, discontinue, restrict, or update any part of the service at any time, including features, sources, summaries, alerts, rankings, filters, AI tools, pricing, and availability.
BlueEM does not guarantee uninterrupted, error-free, secure, or continuous access to the platform.
BlueEM may remove or restrict access to any content, source, feature, or user account if necessary to comply with law, publisher requests, licensing restrictions, technical requirements, security concerns, or business decisions.
15. Disclaimer of Warranties
BlueEM is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, BlueEM disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, reliability, timeliness, merchantability, fitness for a particular purpose, non-infringement, availability, security, and error-free operation.
BlueEM does not warrant that the platform, AI-assisted content, summaries, alerts, rankings, links, metadata, or third-party information will be accurate, complete, current, uninterrupted, secure, or free from errors.
16. Limitation of Liability
To the maximum extent permitted by law, BlueEM and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including loss of profits, loss of revenue, loss of business opportunity, loss of data, reputational harm, trading losses, investment losses, or damages arising from reliance on information provided through BlueEM.
BlueEM’s aggregate liability for any claim arising out of or relating to the service or these Terms will not exceed the amount paid by you to BlueEM in the three months preceding the event giving rise to the claim, or [R$•], whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
17. Indemnification
You agree to indemnify, defend, and hold harmless BlueEM and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- your use or misuse of BlueEM;
- your violation of these Terms;
- your violation of applicable law;
- your infringement or misappropriation of third-party rights;
- content, data, or materials you submit to BlueEM;
- your unauthorized use, reproduction, distribution, or exploitation of BlueEM content or third-party content.
18. Termination
BlueEM may suspend or terminate your access to the service at any time if you violate these Terms, create legal or operational risk, fail to pay applicable fees, misuse the platform, or use BlueEM in a way that may harm BlueEM, users, publishers, rights holders, or third parties.
Upon termination, your right to access and use BlueEM will immediately cease. Sections that by their nature should survive termination will survive, including intellectual property, user restrictions, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.
19. Changes to These Terms
BlueEM may update these Terms from time to time. When we make material changes, we may notify users by posting the updated Terms on the platform, sending an email, or using another reasonable method.
Your continued use of BlueEM after updated Terms become effective means you accept the revised Terms.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of Brazil.
Unless otherwise required by applicable law or agreed in writing, any dispute arising out of or relating to these Terms or the use of BlueEM shall be submitted to the courts of the City of São Paulo, State of São Paulo, Brazil, with express waiver of any other forum, however privileged it may be.
